Federal monitors to watch Louisville polls from outside
Jefferson County Clerk David Yates says Kentucky law bars federal observers from entering voting centers on Nov. 3.

The U.S. Department of Justice intends to place federal election monitors in Louisville for the Nov. 3 general election. However, Jefferson County Clerk David Yates confirmed Monday that state law prevents those observers from entering the polling centers themselves.
The federal agency requested monitors for both Jefferson and Fayette counties. Yates stated his office is still discussing specific arrangements with DOJ officials. The primary legal barrier is Kentucky Revised Statutes 117.235. This statute defines exactly who can be present inside a polling location while voting occurs. Federal election monitors are not on that list.
“We have informed the DOJ that our office can’t authorize, that our office can’t allow federal monitoring inside polling locations,” Yates said. He noted that the law specifically excludes federal observers from the interior of the polling sites.
The DOJ requested the monitors due to concerns regarding accessibility, language assistance, and the handling of provisional ballots. Yates said his office had previously announced a drive-thru voting option to address these specific issues. He has consulted with legal counsel, Fayette County, and the State Board of Elections. All parties agree the federal monitors can remain outside the 100-foot radius of the polling locations.
Yates said he is still waiting for a response from the DOJ regarding the final setup. He told voters to expect Election Day operations to proceed normally. Early non-excuse in-person voting began Thursday and will continue through Saturday at various locations across Jefferson County.
The clerk’s office maintains that the legal framework for Election Day remains unchanged. The federal presence will be limited to the exterior of the voting sites.
